Please read these Terms & Conditions carefully, as they set out our and your legal rights and obligations in relation to our services. By accepting the quotation, paying any part payments prior to work required, and the contract starting, the client is deemed to accept all of the terms and conditions listed below.
These Terms and Conditions were reviewed and updated 1st June 2018.
The quotation is valid for a period of three months from the date shown on the quotation and may be subject to alteration after that date.
The quotation is based on conditions known and divulged by the client at the time of viewing.
Acceptance of the quotation signifies acceptance of these terms and conditions and represents a binding contract between the parties. The notice period for cancellation of work is fourteen calendar days (inclusive) from the date your quotation was agreed.
Any unrecoverable costs incurred in respect of commitments made for materials during that period will be charged in full to the client. For example where the agreed start date is less than 14 calendar days after agreeing your quotation, or New Look Landscapes have secured agreed materials.
For cancellations that do not give New Look Landscapes 14 calendar days (inclusive) notice from the date you agreed your quotation, 50% of all agreed fee rates will be charged. In addition any materials that have been purchased on behalf of the client or any other unrecoverable costs in respect of commitments made during that period e.g. machine hire contracts will be charged to the client. New Look Landscapes will also retain any deposits paid to cover their losses.
Notice of cancellation must be made as soon as possible, initially by telephone and then supported by written confirmation. You can e-mail us at [email protected].
The client will pay any costs related to extra works, or costs due to unknown difficulties or changes, which were not explained at the time of viewing and that have therefore not been noted within the quotation.
The contractor reserves the right to increase quotation prices with prior notification to the client. This will only relate to factors outside New Look Landscape’s control, leading to price increase. Examples are : – Raw materials increases, fuel price increases, minimum wage rate increases.
Any special conditions, of which New Look Landscapes has been informed, will be noted in the quotation i.e. access issues, neighbour disputes.
It is the responsibility of the client to ensure we are made aware of any special/statutory Bylaws/Conditions/Permissions that may be involved.
No allowance is made in the quotation for any extra work required due to unknown, hidden or underground features. Only the work described in the quotation is included; the supply of any other materials or labour costs to carry out such works other than stated within the quotation is excluded. Any alteration, modification or extras beyond the work specified in the quotation may be liable for an additional cost, which will be agreed by both parties prior to being undertaken
Scope of Work
New Look Landscapes shall carry out and complete the landscape work / maintenance work described in the quotation in a professional manner. They shall have no obligation to execute any further work unless agreed in writing between both parties of the contract
If there is any discrepancy between any specification and any drawing, the description contained in the specification shall prevail over the drawing
The client is to indicate the line of the boundaries, underground cables and pipes before work commences and New Look Landscapes accepts no liability whatsoever for any losses or future disputes which the client may have with the owner(s) of neighbouring properties or other parties as a result of works which it carries out on or within the boundaries, cables or pipes that the client has indicated to us.
The client is solely responsible for obtaining any planning permission required, including the preparation and submission to the local authority of any necessary applications. New Look Landscapes and their staff accept no responsibility for works that have been carried out on land that is not under the ownership of the client and it is assumed that all planning laws or regulations have been applied before commencement of any works.
Copyright laws cover all designs. The New Look Landscapes design cannot be reproduced without prior written consent by Kevin Lawrence, New Look Landscapes. The client may, if so desired, approach other contractors to quote for the project. The design by New Look Landscapes and it’s staff will remain copyright to New Look Landscapes. It must not be used in any form by a third party unless specifically authorised by Kevin Lawrence, New Look Landscapes.
The client commits to granting sufficient and reasonable access to the site throughout the period of execution of the contract. Proper and adequate access must be made available by the client to New Look Landscapes to enable the work to be carried out in a regular and economic manner.
The client confirms that the site is free from springs, flooding, rock, tree stumps not specified to be removed, mine workings, covered wells or other cavities, running sand, service pipes and cables, sewage or land drains, foundations or other hazards or obstructions which are not discoverable upon visual inspection of the surface of the site or made known in writing to New Look Landscapes prior to the submission date of the quotation. New Look Landscapes shall be entitled to make a reasonable charge for all additional work necessary resulting from the discovery of such hazards.
The client will provide access as needed to water, electricity and toilet facilities wherever possible for use by New Look Landscapes in carrying out the work agreed. The provisions of these services and facilities shall be at the sole cost of the client.
The client shall be responsible for ensuring the safety of their children, family members, pets, animals and visitors at all times whilst work is being carried out on their premises.
New Look Landscapes shall be free from any liabilities, structural or accidental, when using machinery, except for accidents caused by improper use. The client is responsible for any and all plant on site once New Look Landscapes staff and / or subcontractors have left site after a working day.
The client will remove and dispose of any pet waste before work begins.
The client will move any garden furniture, children’s play equipment, pots etc prior to work commencing.
New Look Landscapes will make all reasonable efforts to complete the work within a reasonable timeframe or by a specific date if agreed. However, unforeseen circumstances such as weather may hinder progress, and New Look Landscapes will endeavour to keep the client informed.
Delays and Disruptions
New Look Landscapes will make every effort to complete the work within a reasonable time or by a specified date if agreed. Under no circumstance shall New Look Landscapes incur any liability to the client for any untimely performance or delays arising from force majeure, adverse weather conditions or events beyond their reasonable control.
Weather conditions, including, but not limited to, snow, hard frost, extreme rain, excessive heat or drought may cause the delay of a start or completion date of a contract. We will always inform you at the earliest, most convenient time of any such expected delays.
Staff illness / death of family members may cause unavoidable delays to landscaping projects. If a member of our team has an illness or is off work due to an extenuating circumstance which is beyond their control and this is going to affect a start or end date of a project, you will be informed as soon as possible. We will always endeavour to start and complete landscaping jobs on time.
Delays caused by companies working on site that have not been contracted / employed by New Look Landscapes will result in charges to the client to recover our loses / costs.
New Look Landscapes will always inform you as soon as is practically possible if we need to alter your landscaping start or completion date for any reason.
New Look Landscapes always uses reputable high quality suppliers for the supply of plants, trees and shrubs; however we are unable to guarantee their performance once we have left the site.
It is the clients’ responsibility to water / feed turf, plants, hanging baskets, newly planted shrubs / trees after a landscaping project has been completed. Upon practical completion the responsibility for the care and watering of all living matter is handed over to the client and will require regular attention until established. Should the client wish New Look Landscapes to manage the aftercare and ongoing maintenance after the landscaping project has been completed, the client must agree this service provision under a formal maintenance contract soon after project completion so as not to allow degradation to occur.
Any plants, shrubs, trees purchased or delivered to site cannot be exchanged or returned.
Natural products may show some colour and / or texture,or spacial variations; therefore New Look Landscapes cannot guarantee supplied materials are exact representations of any samples provided.
New Look Landscapes will research and take the advice of the supplier as to the best way to lay/build with the material and the best adhesives and seals to use. If there are any problems arising with the product and the supplier advice has been taken, New Look Landscapes accepts no responsibility, except where it has been improperly installed by New Look Landscapes.
Materials delivered to site and tools left on site become the responsibility of the client. New Look Landscapes accepts no responsibility for loss damage or expense after delivery of materials to site for any reason. Delivered plants if not planted immediately will be stowed in an agreed location within the client’s garden. At this stage responsibility for the loss or theft of these plants will rest with the client.
Wood is a natural product, and is therefore susceptible to certain changes in an outdoor environment. Extremes of temperature or weather conditions will cause a reaction. Certain conditions may cause products to split, lose shape or warp. This is natural and in all but the most extreme cases, normal shape will be resumed. New Look Landscapes cannot be held responsible for the above taking place.
In extreme changes of weather conditions, certain plants and materials such as: terracotta, some natural stone and other paving can be affected, suffering damage if not protected. The client should take the necessary precautions to prevent damage as this is out of New Look Landscapes’ control
All materials brought to site which prove to be in excess to New Look Landscapes requirements shall remain the property of and shall be removable by New Look Landscapes who shall have the right to enter the site for that purpose.
Part payment will be required for the cost of materials before work commences.
The client accepts that on project completion, the client will be required to sign off the works and pay New Look Landscapes the remaining contract balance (all costs incurred minus any part payments already paid) together with Value Added Tax within 7 days.
The client will pay any extra works, or costs due to unknown difficulties or changes, which are not within the estimate. Final parking charges and congestion charges will be added if applicable.
Unless otherwise stated payments are due 7 days following receipt of invoice.
Payments should be made to New Look Landscapes either by Bank Transfer (ask for details), cash, or cheques made payable to Newlooklandscapes. You will always receive a receipt via e-mail for any payments made.
If the invoice is not settled within 14 days New Look Landscapes reserves the right to charge daily interest at 2% until full payment is received.
Materials need to be purchased in advance and will form part of the first stage deposit, payable one week in advance of the agreed start date. If this or any invoices, are not paid within seven days of being rendered the client will be deemed to be in default and therefore in breach of contract. New Look Landscapes will then be entitled to cease work and remove all materials remaining unused on the site and recover from the client his whole loss and expenses arising out of the said default by the client.
In the event it is necessary to institute legal recovery of the outstanding sum the client will be liable to pay New Look Landscapes legal fees in full.
If the delivery date of goods is delayed by the customer, New Look Landscapes reserves the right to charge the client the daily labour rate for all staff on site until the material arrives.
In the event that a change in materials from that already delivered on-site is required as a result from a subsequent client change of mind, the client will be solely responsible for payment of all additional costs.
New Look Landscapes run a very busy, carefully managed garden maintenance service throughout the year. This may involve us visiting your property weekly / bi weekly / monthly - the choice is yours.
Clients shall commit to the days and dates arranged with New Look Landscapes for the period of their contract unless changes are agreed by both parties.
New Look Landscapes reserves the right to refuse or withdraw our maintenance services at any time during your contract with us.
Clients who abuse our maintenance routines or services will be withdrawn from our services permanently. Any advance payment will be retained to cover our loss of earnings.
Clients have the right to alter or cancel their garden maintenance contract with us at any time in writing. You must give us at least seven days notice of any changes in your plans so that we can reorganise our work schedule accordingly. A full refund of any client’s advance payment will be made.
Clients who cancel scheduled visits, then leave long periods between their next appointment with New Look Landscapes can expect our rate to increase upon our next visit to their property. If your garden is not regularly maintained, then lawns, hedges, shrubs and plants will become overgrown. This in turn will create more work, and more waste for New Look Landscapes to dispose of. In these instances New Look Landscapes will re-quote your maintenance price as a one-off job, then continue with the previous rate if the garden is again regularly maintained i.e. weekly, bi-weekly or monthly.
Clients agree to remove dog / cat waste, hazardous waste, and litter etc from any areas we will be working in prior to our visit.
It is the client’s responsibility to ensure any children’s play equipment or other garden furniture or obstacles are moved off the area you wish us to work on.
For your own and our safety please ensure that any pets and / or young children are kept indoors whilst we are working on your property.
Our day rate is for 8 hours per gardener. Unless a fixed price quotation has been agreed prior to work commencing, we will apply the day rate / hourly rate plus materials and expenses to the clients invoice.
If we are required to remove any waste from the site, this will be subject to additional charges, as will parking and congestion charges if applicable.
New Look Landscapes will undertake any requested jetwashing, but accept no claim or compensation arising from any damage caused by the high pressure cleaning.
For regular maintenance work an invoice will be issued at the end of the month. Clients are requested to pay within 14 days of receipt of the invoice
Photographs / videos
New Look Landscapes photograph and video all of our landscaping and garden maintenance work before & after. These photographs / videos may be used on our website, Facebook business page and other social media. Photographs and videos are used to advertise our business and our work. Due to GDPR we will not use any photographs / videos that display any personal information that could be used to identify the client. This includes but is not limited to photographs / videos that show people.
New Look Landscapes reserves the right to publish photographs / videos of our landscaping and garden maintenance work on our printed marketing materials, business website www.newlooklandscapes.co.uk, our Facebook business page and other social media.
Customer care policy
New Look Landscapes is proud of the value, quality and dependability of the services it provides.
If the client is not fully satisfied with any part of our service, then please inform us in writing.
We treat our clients concerns and comments as constructive and positive feedback and can only improve our services if informed of any shortcomings.
If there is concern in regard to any aspect of the services we are contracted to undertake, the client must inform New Look Landscapes immediately in writing.
New Look Landscapes guarantees to investigate and respond to your concerns within 14 working days.
